Illegal alien demands free car

By Michelle Malkin  •  January 25, 2007 11:09 PM

What the open-borders entitlement culture has wrought (via Chicago Sun-Times):

Winning a Chevrolet Corvette is the stuff of dreams.

In Maribel Nava Alvarez’s case, it has been a nightmare.

The former Little Village resident said officials with local radio station La Ley 107.9 FM and its parent company, Spanish Broadcasting System, withheld the gray sports car she won in a La Ley raffle when they discovered she was an undocumented resident.

“Undocumented resident.” Someone actually wrote and approved the use of that phrase with a straight face.

What’s worse, she said, is that an SBS attorney allegedly threatened to alert authorities of her immigration status once he learned she intended to take her battle to court.

“I was very sad. I cried. … My feelings were hurt because I was mocked,” Alvarez, 22, said in her native Spanish on Wednesday. “It’s unjust.”

Despite La Ley’s claims, Alvarez said she was never informed verbally or in print that she had to be U.S. citizen or legal resident to be eligible to win Mexican-American singer Juan Rivera’s old car during the July 4, 2005, contest at the Plaza Garibaldi, 2600 S. California.

The only condition was that the potential winner had to be present at the drawing, said Alvarez, who recently sued both companies for breach of contract and emotional distress.

The distress stems from a letter Alvarez received from the radio station’s lawyer, who informed her counsel:

“I will caution you that if you insist on filing suit against SBS. I will in turn be forced to refer this matter to U.S. Immigration and Customs Enforcement as I believe your client is in this country illegally. Please communicate that to your client for her consideration.”

Doesn’t matter to Alvarez that the station is itself pro-amnesty and actually tried to give her the car even though her tax reporting information could not be verified. She wants her car–tax and immigration laws be damned!

The trend is catching on:

In a separate incident earlier this month, Toys R Us agreed to award a Chinese-American infant born in New York a $25,000 prize in a New Year’s baby contest after the company was criticized for disqualifying the girl because her mother was an illegal immigrant.

Although promotional materials recruited “all expectant New Year’s mothers” to apply for the contest, eligibility rules required the babies’ mothers to be legal residents.

Brian Maloney is tracking response at the radio station’s website.

Rick Moran weighs in:

…I don’t know what’s more shocking; the fact that the station tried to give her the car anyway without collecting the necessary tax information or the unmitigated gall of the woman to sue for “emotional distress.” Living here illegally is emotionally distressing in and of itself. But to try and soak a radio station for trying to follow the law and deny her the benefit of her ill gotten gains is beyond the pale, beyond avarice, and beyond belief…

…The woman is a fool. She should have waited a few months when the amnesty bill that will almost surely be passed gives her everything her little mercenary heart desires.

Until then, I sure hope she finds a way to deal with her “emotional distress.”

The article reports that Alvarez is now in hiding and in fear of being deported. Not likely. Ask fellow Illinois “undocumented resident” Elvira Arellano–arrested four years ago in an illegal alien sweep, issued a final order of deportation last August, and left untouched after taking refuge in a West Side Chicago Catholic Church, where she remains today. Biding her time ’til that amnesty passes.

Maybe Oprah will give them both cars while they wait (but be careful what you wish for, grievance-mongers).
