<p>Surprise, surprise, Part II.</p>
<p>Yesterday, I discussed the <a href="http://michellemalkin.com/2011/08/22/white-house-deportation-waivers-by-executive-fiat/">White House deportation waivers</a> &#8212; a blanket amnesty through administrative non-enforcement that will benefit at least an estimated <a href="http://michellemalkin.com/2010/11/19/dream-act-nightmare-2-1-million-future-democrat-voter-recruitment-drive/">2.1 million future Democratic voters.</a></p>
<p>Today, the New York Times brings news of the first lucky winners of the Obama amnesty golden tickets.</p>
<p>You&#8217;ll be shocked, shocked to learn that they include a <a href="http://www.nytimes.com/2011/08/23/us/23immig.html">27-year-old leading DREAM Act illegal alien student bailout activist and a lesbian gay marriage activist:</a></p>
<blockquote><p>Administration officials and immigrant advocates said Monday that the plan offered the first real possibility since President Obama took office — promising immigrants and Latinos he would overhaul the law to bring illegal immigrants into the system — for large numbers of those immigrants to be spared from detention and deportation.</p>
<p>For Mr. Guerra, who said he wants to remain in the United States to study to become a Roman Catholic priest, the news “was like something from above, from heaven. I don’t want to go back to Mexico,” he said, “and I’ve been fighting this for five years.” </p>
<p>&#8230;Mr. Guerra, now 27 and living in Indiantown, Fla., is one of those immigrants. He said he came to this country to escape a violent gang in Mexico. His lawyer, Richard A. Hujber, said Mr. Guerra’s efforts to straighten out his legal status went wrong because they were originally mishandled by an accountant claiming falsely to be a lawyer.</p>
<p>In recent years, even though he was undocumented, Mr. Guerra has been a Florida leader of the illegal immigrant student movement, helping to organize a protest walk by four students to Washington and a mock university held by students wearing mortarboards on Capitol Hill.</p>
<p>“That was so big to me, all these students organizing a school so we could go without our papers,” Mr. Guerra said. If he can obtain a work permit, he and Mr. Hujber said, he could be legally eligible for the first time to apply for financial aid that would allow him to continue his religious studies.</p>
<p>The administration’s announcement also had an immediate impact on a case in Denver, where an immigration judge on Friday postponed the deportation of Sujey Pando, a lesbian from Mexico legally married in Iowa to an American from Colorado, Violeta Pando. Although federal law does not recognize same-sex marriages, administration officials said they would consider same-sex spouses as “family” in their review of deportation cases.</p>
<p>The judge, Mimi Tsankov, cited the flux in laws and policies affecting same-sex cases in delaying a decision on Sujey Pando’s deportation at least until January, said Lavi Soloway, a lawyer for the couple. </p></blockquote>
<p>Prediction: When all is said and done, the Obama-Biden deportation waiver program will make the fraud-ridden, Clinton-Gore <a href="http://michellemalkin.com/2008/02/06/where-hillarys-latino-votes-came-from/">Citizenship USA program</a> look like kindergarten.</p>
<p>Remember: <a href="http://www.cis.org/DeportationSystem">It ain&#8217;t over &#8217;til the alien wins.</a></p>

<p>Before I get to the big and disappointing announcement this afternoon, I want to share an e-mail from a Utah Tea Party leader <strong>in Utah</strong> who was incensed that the movement to unseat entrenched incumbent GOP Sen. Orrin Hatch was falsely portrayed as an &#8220;outside&#8221; campaign orchestrated by nefarious forces:</p>
<p><em>Dear Michelle,</p>
<p>Most of the most prominent, active and influential tea party leaders in Utah have been working together for months to get outside support to defeat Hatch.  <strong>WE</strong> went after them in our David/Goliath situation. I know of no real tea party leaders who support Hatch, with the exception of a few on his payroll.  <a href="http://michellemalkin.com/2011/08/19/ugh-greta-and-sarah-palin-rally-behind-tea-party-poser-orrin-hatch/">Greta is soooo wrong about the Utah Tea Party.</a></p>

<p>You are right on in referring to Sen. Hatch as a Tea Party Poser.  I am a Utah voter and one who would have voted Sen. Bennett out had I been given the opportunity.  I loved that he was removed prior to it coming to a vote.  I plan to vote out Sen. Hatch too. <p>Some have suggested that we (Utahns) should vote him back in because of the power he would have as committe chair.  I say that is the very reason he should go because I don&#8217;t think senators should be voted in for the power they wield but the principles they stand for. </p>

<p>GOP Rep. Jason Chaffetz had raised the hopes of grass-roots conservative activists outside the Beltway for months with strong indications that he would mount a David vs. Goliath <a href="http://www.sltrib.com/sltrib/politics/52432938-90/chaffetz-hatch-utah-challenge.html.csp">challenge</a> to the four-decade incumbent Hatch:</p>
<blockquote><p>The Chaffetz calculus is not simple.</p>
<p>On one hand, Hatch is widely seen as vulnerable to a conservative challenger and Chaffetz is well-known and liked among Utah’s tea party base.</p>
<p>However, Chaffetz was a leading spokesman for House conservatives during the recent debt ceiling debate and sponsor of the Cut, Cap and Balance proposal, which advocated slashing government spending and requiring Congress to pass a balanced budget amendment.</p>
<p>He would have to give up that rising stature in the House to go against a senior senator in Hatch, who has a decisive fund-raising advantage and has been working feverishly for several months to repair relationships in Utah.</p>
<p>Chaffetz held several town hall meetings around the state — many of them outside of his congressional district — over the last several weeks where he drew cheers blasting Hatch and said he would make his announcement sometime in September.</p></blockquote>
<p>Unfortunately, Chaffetz is bowing out this afternoon. I confirmed it with him by phone. He still thinks Utah needs fresh blood and that &#8220;Hatch is everything that is wrong with Washington,&#8221; but says he believes he&#8217;ll better serve the fiscal conservative cause by staying in the House and holding GOP leadership&#8217;s feet to the fire.</p>
<p>I understand his reasoning, but I know there are many grass-roots conservatives who have watched the Orrin Hatch Machine at work and are heartbroken. </p>
<p>Over the past few weeks, Hatch has sucked up to national conservative figures, mounted a desperate rehab effort to bolster what few conservative credentials he has left, and, according to my sources, used his incumbency machine to buy off erstwhile Tea Party leaders.</p>
<p>I have been told that local and state vendors, pollsters, and campaign literature printers in Utah have all been scared off doing any work for any potential Hatch challenger.</p>
<p>Utah Tea Party activists tell me they are scouting out other possibilities, but that the prospect of opposing the GOP establishment and Hatch&#8217;s machine is daunting.</p>
<p>It&#8217;s Chicago on the Wasatch Front.</p>
<p>But it&#8217;s not an impossible task &#8212; as Chaffetz himself showed in his <a href="http://michellemalkin.com/2008/06/25/shamnesty-republican-chris-cannon-defeated-in-utah-primary/">upstart victory over entrenched incumbent Rep. Chris Cannon</a> and as <a href="http://michellemalkin.com/2010/05/10/dltdhyotwo-bob-bennett-gets-the-boot-and-next/">Sen. Mike Lee demonstrated over former Sen. Bob Bennett.</a></p>
<p>The next battle now, Tea Party folks in Utah tell me, is over a brazen bid by establishment types to do away with the very caucus system that produced Tea Party upstarts who could surmount the perks of incumbency. Bill Clayton of Sandy, Utah explains:</p>
<blockquote><p>Primary elections for county, state, and federal offices in Utah only take place when no single candidate gets 60% of the delegates&#8217; votes at his party&#8217;s county or state convention, in which case the two finalists face off in a primary.  Bob Bennett was ejected during the second of three rounds of balloting at the 2010 Utah State GOP Convention in May.  So not only did he not make it to a primary; he didn&#8217;t even make it into the third round at the convention. The third round was between Tim Bridgewater and Mike Lee.  Because neither Lee nor Bridgewater got 60% in that round, they faced off in a primary election in June.</p>
<p>Had Bennett been forced into a primary, the political establishment would have found this shocking.  Incumbents normally sail cleanly out of the convention.  Had Bennett lost such a primary, the establishment would found this earth-shattering.  But his failure to even make it to the third round at the convention was so far outside the realm of accepted political wisdom as to be completely mind-blowing to the establishment.  The funny thing is that most delegates, when talking with other delegates during the weeks before the convention, concluded that Bennett was toast.  If anyone from the establishment had bothered to attend a local GOP caucus meeting in March, he would have observed that the anti-Bennett sentiment was so thick in these meetings that one could cut it with a knife.</p>
<p>The first sign of revolt in the Republican ranks in Utah actually happened in 2008, when Jason Chaffetz defeated incumbent RINO congressman Chris Cannon at the state convention a year before the Tea Party came into being.  We Beehive-State Tea Partiers are proud to set good precedents!</p></blockquote>
<p>Let&#8217;s hope they continue the trend and continue the fight &#8212; even if it means opposing some of the leading lights of the Republican Party trying to whitewash Hatch&#8217;s four-decade-old record as a <a href="http://www.hatchrecord.com/index.php/the-truth/">Nanny State/open-borders/&#8221;bipartisan&#8221; tool.</a></p>
<p>We need contested caucuses and primaries, not coronations. Remember, as one of the original Tea Party slogans put it so well:</p>

<p>No, it&#8217;s about as unsurprising as the setting sun or the rising sun. </p>
<p>The Obama Department of Homeland Security late last week announced it would enforce the DREAM Act illegal alien student bailout by administrative order &#8212; call them White House <a href="http://michellemalkin.com/2010/11/22/dianne-feinstein-grants-an-illegal-alien-deportation-waiver/">deportation waivers</a> &#8212; over the heads of a bipartisan majority of Congress that has repeatedly and resoundingly rejected such proposals.</p>
<p>They administration didn&#8217;t put it in such stark terms, of course. But that is the effect of the decree.</p>
<p>And it is no surprise at all to you and me.</p>
<p>The open-borders radicals at the White House and within DHS have been telegraphing this for months.</p>
<p>In June, they <a href="http://michellemalkin.com/2010/06/23/the-threat-of-illegal-alien-amnesty-by-executive-order/">floated a proposal to order deferred/administrative paroles for masses of illegal aliens.</a> ICE issued <a href="http://michellemalkin.com/2011/06/22/document-drop-ice-memos-open-another-door-to-illegal-alien-amnesty-by-fiat/">memos</a> listed extensive criteria for &#8220;prosecutorial discretion&#8221; on deportation enforcement &#8212; chief among them, the vast subset of illegal aliens who would qualify for the failed DREAM Act illegal alien student bailout.</p>
<p>And now, as of last Thursday, DHS will <a href="http://www.nytimes.com/2011/08/19/us/19immig.html?_r=1">formally suspend all deportations of potential DREAM Act illegal alien beneficiaries</a> on a case by case basis as part of a coordinated campaign to <a href="http://www.washingtonpost.com/todays_paper/A%20Section/2011-08-22/A/1/26.1.914507258_epaper.html">woo disenchanted Hispanic voters.</a></p>
<p>The <a href="http://michellemalkin.com/2011/07/18/the-truth-about-deportation/">truth about deportation</a>, as I&#8217;ve reported over and over and over again through the years, is that both Democrat and Republican administrations have undermined an orderly, consistent system of enforcement. And most of the politicians in Washington who speak about &#8220;comprehensive immigration reform&#8221; are still abjectly ignorant about the ins, outs, loopholes, and lax enforcement that characterize our <a href="http://www.cis.org/articles/2002/back1002.html">chaotic, security-undermining deportation policies.</a> It&#8217;s an <a href="http://michellemalkin.com/2007/06/13/welcome-to-the-deportation-abyss/">endless appeals process and immigration litigation lottery</a> played by deportable aliens and their open-borders lawyers. Capitol Hill compounds the problem with a raft of <a href="http://michellemalkin.com/2007/06/11/how-congress-gives-special-relief-to-convicted-murderers-smugglers-and-other-alien-law-breakers/">special private relief bills</a> that protect illegal alien criminals.</p>
<p>The question for 2012 GOP primary voters: Is there a candidate out there who you trust to stand on the side of secure borders and strict enforcement, who has consistently opposed DREAM Act illegal alien bailouts, and who will resist the urge to use and abuse his executive powers to override the will of the people?</p>

<p>As faithful readers of this blog know, I was reporting on the Tea Party movement <a href="http://michellemalkin.com/2009/02/15/taxpayer-revolt-porkulus-protest-in-seattle/">long</a> <a href="http://michellemalkin.com/2009/02/16/from-the-boston-tea-party-to-your-neighborhood-pork-protest/">before</a> it was even called the <a href="http://michellemalkin.com/2009/02/20/rebel-yell-taxpayers-revolt-against-gimme-mania/">Tea Party movement</a> &#8212; and long <a href="http://michellemalkin.com/2009/02/16/signs-of-the-day/">before</a> a legion of <a href="http://thehill.com/blogs/blog-briefing-room/news/174657-sen-mccain-credits-the-tea-party-for-deficit-agreement">Johnny-come-latelys</a> in Washington had grabbed their fiscal conservative costumes and joined the parade. I can remember not being able to get mainstream media coverage on the day of one of the first taxpayer protests in Denver in <a href="http://michellemalkin.com/2009/02/17/yes-we-care-porkulus-protesters-holler-back/">February 2009</a>. We&#8217;ve come a <a href="http://michellemalkin.com/2010/11/02/flashback-weve-come-a-long-way-baby/">long way</a>, baby. From day one, I emphasized that the grass-roots activists leading the Tea Party charge have been <a href="http://michellemalkin.com/2009/04/17/the-million-taxpayer-march/">as opposed to Big Government Republicans</a> as they have to Big Government Democrats. They and I have not forgotten that <a href="http://michellemalkin.com/2010/11/09/bush-nostalgia-lets-not-get-carried-away-ok/">bailout-mania began under the Bush administration</a>, which <a href="http://michellemalkin.com/2008/12/16/george-w-bushs-political-epitaph/">pre-socialized</a> the economy and handed it on a silver platter to Barack Obama.</p>
<p>Which brings me to GOP Utah Sen. Orrin Hatch.</p>
<p>The other day, he had the unfathomable audacity to proclaim himself a <a href="http://www.politico.com/news/stories/0811/60473.html">&#8220;Tea Party person.&#8221;</a></p>
<blockquote><p>“Look, I think the tea party people deserve a lot of credit,” he said in response to a question about Democrats and Vice President Joe Biden reportedly calling freshman GOP members of Congress terrorists.</p>
<p>“We wouldn’t be where we are without them. The fact of the matter is <strong>I’ve been a tea party person I think since before the tea party came into existence.[emphasis added] </strong> </p></blockquote>
<p>Are you freaking kidding me?</p>
<p>Orrin Hatch is the <em>antithesis</em> of the Tea Party spirit. He is a mascot for big-spending Beltway entrenched incumbency who has consistently joined hands with destructive Democrats.</p>
<p>He <a href="http://michellemalkin.com/2009/07/17/a-slobbering-love-affair-orrin-hatch-and-chris-dodd/">slobbered over corruptocrat Democratic Sen. Chris Dodd.</a></p>

<p>He was an <a href="http://www.change.org/petitions/thank-orrin-hatch-for-supporting-the-dream-act-and-ask-him-to-cosponsor">original sponsor</a> of the open-borders <a href="http://michellemalkin.com/2010/09/17/harry-reids-illegal-alien-student-bailout/">DREAM Act illegal alien student bailout</a> and <a href="http://thecaucus.blogs.nytimes.com/2011/02/11/conservatives-heckle-hatch-on-tarp-vote/">voted for the massive TARP bailout.</a></p>
<p>How do real Tea Party people feel about Tea Party pretender Orrin Hatch?</p>
<p>The same way they feel about his former big-spending entrenched incumbent in Utah &#8212; <a href="http://michellemalkin.com/2010/05/10/dltdhyotwo-bob-bennett-gets-the-boot-and-next/">former Sen. Bob Bennett</a> &#8212; who got the boot in May.</p>

<p>Now, the six-term Hatch &#8212; first elected in 1976 on an anti-entrenched incumbent platform (Hatch&#8217;s campaign line then against his opponent Frank Moss: <a href="http://www.ksl.com/index.php?nid=1013&#038;sid=16005079">&#8220;What do you call a Senator who&#8217;s served in office for 18 years? You call him home&#8221;</a>) &#8212; wants to stay in Washington yet another term after FOUR DECADES in government. He has been lining up some big conservative names. And now there is some sort of <a href="http://dailycaller.com/2011/08/05/%E2%80%98who-is-dick-armey%E2%80%99-attack-website-surfaces/">pro-Hatch, anti-Freedomworks website</a> using my words to support Hatch.</p>
<p>I don&#8217;t know what the beef is between Dick Armey and Orrin Hatch. But I will tell you this: While <a href="http://michellemalkin.com/2010/03/17/in-response-to-amnesty-stooge-dick-armey/">Armey&#8217;s pro-amnesty stance</a> bothers me, bailout Swamp Creature Orrin Hatch&#8217;s desperate bid to cling to power by morphing himself into a Tea Party cheerleader aggravates me far more.</p>
<p>I will do whatever I can to support Hatch&#8217;s challenger &#8212; <a href="http://blogs.abcnews.com/thenote/2011/07/hatch-vs-chaffetz-looks-to-be-a-brutal-battle.html">likely the staunch conservative GOP Rep. Jason Chaffetz</a>, who is a fiscal warrior, tough on illegal immigration, and has a <a href="http://michellemalkin.com/2008/06/25/shamnesty-republican-chris-cannon-defeated-in-utah-primary/">terrific record taking down the GOP establishment</a>.</p>
<p><s>Forty-two</s> Thirty-six continuous years and untold trillions of dollars in expanded government is enough &#8212; 42 is too much. </p>
<p>It&#8217;s time for Orrin Hatch to go.</p>

			<content:encoded><![CDATA[<p>Nine years ago, I published <em><a href="http://www.amazon.com/Invasion-America-Welcomes-Terrorists-Criminals/dp/0895260751">Invasion</a></em> and have since devoted extensive column, blog, and broadcast space to informing readers about <a href="http://michellemalkin.com/category/immigration/deportation/">America&#8217;s deportation abyss.</a></p>
<p>Most of the politicians in Washington who speak about &#8220;comprehensive immigration reform&#8221; are still abjectly ignorant about the ins, outs, loopholes, and lax enforcement that characterize our <a href="http://www.cis.org/articles/2002/back1002.html">chaotic, security-undermining deportation policies.</a> It&#8217;s an <a href="http://michellemalkin.com/2007/06/13/welcome-to-the-deportation-abyss/">endless appeals process and immigration litigation lottery</a> played by deportable aliens and their open-borders lawyers. Capitol Hill compounds the problem with a raft of <a href="http://michellemalkin.com/2007/06/11/how-congress-gives-special-relief-to-convicted-murderers-smugglers-and-other-alien-law-breakers/">special private relief bills</a> that protect illegal alien criminals.</p>
<p>The <a href="http://www.cis.org/deportation-basics">Center for Immigration Studies</a> is out with a brand new report today on deportation basics.</p>
<p>Among the key findings:</p>
<p><em></p>
<p>    * A large percentage of aliens flee from removal proceedings – perhaps as many as 59 percent of all those released to await hearings. On a cost basis from the alien’s perspective, this makes sense. If you are in proceedings and have little chance of relief, why not treat the bond money (if it’s even required) as the cost of having been caught, and then flee, hoping to stay under the radar for as long as possible, perhaps until the next amnesty?</p>
<p>    * Though fashionable in the Obama administration, the exercise of “prosecutorial discretion” is problematic for ICE field officers. If the alien that they decline to remove goes on to commit a heinous act, they could be subject to lawsuits from victims and will be held accountable by their own agency (even if agency leadership encourages them to use the tool).</p>
<p>    * Even in today’s technology-driven world, charging an alien with immigration violations is a paperwork-intensive, cumbersome process that requires agents to fill out nearly 20 different forms each time.</p>
<p>    * ICE officers are supposed to consider two key factors in determining whether to detain or release an alien in proceedings – if the alien is a flight risk and if he is a risk to the community. The latter factor obviously is given serious consideration, but it is equally obvious from the large number of absconders that officers don’t give the same weight to the likelihood of flight, especially considering the scarcity of funded detention space.</p>
<p>    * The Immigration and Nationality Act (INA) provides for several types of due process for aliens, depending on their circumstances of arrival and stay. The law does not require that all removals be ordered by an immigration judge.</p>
<p>    * The option of Voluntary Return, where the alien requests to be returned home in lieu of formal removal proceedings, is not really “voluntary,” but is beneficial to the alien because it carries fewer consequences if the alien returns illegally. It also has become subject to overuse or misuse in recent years as a tool to increase the volume of removals, at the expense of more formal methods of removal that have more deterrent value.</p>
<p>    * Immigration law provides for seven ways to remove an alien, which are explained in the report. Four of these options are relatively efficient, but used less frequently. If ICE chose to expand their use, the workload of the immigration court could be reduced and the immigration enforcement system would be less dysfunctional.</p>
<p>    * The total number of apprehensions of illegal aliens by immigration enforcement agencies is less than half of what it was five years ago. For instance, the drop in apprehensions by Customs and Border Protection (CBP) is often explained by improvements in border security; however, this rationale is suspect, as has been pointed out by the Rand Corp. in a study of border metrics. But ICE apprehensions also have dropped steeply, although there has been only a modest drop in the size of the illegal population inside the United States.</em></p>
<p>The report comes as <a href="http://thebostonpilot.com/article.asp?ID=13556">left-wing religious leaders</a> continue to lobby for the DREAM Act illegal alien student bailout. Make sure you are armed with the facts to counter the emotion-driven juggernaut:</p>
<blockquote><p>As the effort to pass the DREAM Act hits its 10th anniversary, churches, synagogues and mosques around the country will devote a September weekend to teaching their congregations about the faith-based reasons to work for its passage.</p>
<p>Sen. Dick Durbin, D-Ill., flanked by priests, bishops, rabbis, ministers and an imam, announced July 12 in a news conference at the Capitol that Sept. 23-25 will be DREAM Act Sabbath. Faith leaders said they and their fellows would devote time during or after worship services to explaining the legislation and offering testimony from young people who would be affected by it, all geared toward mustering legislative support.</p>
<p>&#8230;Cardinal Theodore E. McCarrick, retired archbishop of Washington, said at the press conference that &#8220;these are Americans, for all practical purposes,&#8221; and that many DREAM Act supporters, who call themselves &#8220;Dreamers&#8221; risk deportation in order to advocate for the chance to become U.S. citizens through its provisions.</p>
<p>&#8220;Why would we not want to embrace their dedication, energy, talents, and courage &#8212; characteristics that have made our nation great? It would be to our detriment to forsake them.&#8221;</p>
<p>He said that speaking on behalf of fellow bishops, &#8220;we plan to promote the DREAM Act Sabbath.&#8221;</p>
<p>The Rev. Samuel Rodriguez, president of the National Hispanic Christian Leadership Conference, linked the effort to Scripture. &#8220;Christ himself admonished us to permit the little ones, the children, to come to him for the Kingdom of Heaven belongs to them.&#8221;</p></blockquote>

<p>When Illinois Senator Dick Durbin looks at a crowd of Tea Partying American citizens, he sees <a href="http://biggovernment.com/amarcus/2010/10/23/dick-durbin-labels-all-tea-partiers-extremist/">extremists</a> and a bunch of fringe wackos who <a href="http://www.galesburg.com/newsnow/x1389366115/Durbin-slams-Tea-Party-rallies-local-Dems">don&#8217;t speak for America</a>. When he looks at a roomful of illegal aliens he sees the future of America, and maybe even <a href="http://www.cnsnews.com/news/article/durbin-maybe-illegal-alien-will-become-p">the next US president</a>:</p>
<blockquote><p>(CNSNews.com) &#8211; Senate Democratic Whip Dick Durbin (Ill.) said in a congressional hearing Tuesday that a young person who is an illegal alien in the United States today may someday become president.</p>
<p>“When I look around this room, I see America&#8217;s future, our doctors, our teachers, our nurses, our engineers, our scientists, our soldiers, our congressmen, our senators, and maybe our president,” Durbin said immediately after having asked all young persons in the room to stand if they were currently undocumented aliens who would be eligible to become citizens if the DREAM Act were passed.</p></blockquote>
<p>He must also see a constitutional amendment to allow that to happen &#8212; but why should Durbin let a little piece of <a href="http://www.presidentsusa.net/qualifications.html">antiquated paper</a> mess up his DREAM?</p>

<p>Vargas&#8217;s splashy revelations in the New York Times come &#8212; no coincidence, of course &#8212; amid a <a href="http://www.google.com/hostednews/ap/article/ALeqM5jXF6itgyn8PueQAHV-OeQl6W3j0Q?docId=cc591090beb741b2a46496c0e7197572">renewed push</a> for the DREAM Act illegal alien student bailout. </p>
<p>Remember: This is a brazen <a href="http://thehill.com/homenews/administration/129499-obama-hispanic-caucus-push-for-dream-act-passage-in-lame-duck">&#8220;down payment&#8221;</a> on a larger shamnesty.</p>
<p>Remember: This is nothing more than a <a href="http://michellemalkin.com/2010/11/19/dream-act-nightmare-2-1-million-future-democrat-voter-recruitment-drive/">2.1 million future Democrat voter recruitment drive</a> and a <a href="http://michellemalkin.com/2010/11/30/dream-act-nightmare-a-massive-open-borders-entitlement-program/">massive open-borders entitlement program</a> for untold numbers of <a href="http://michellemalkin.com/2010/12/14/video-ucla-open-borders-prof-urges-dream-ers-to-replace-those-old-white-guys/">multi-culti ethnic tribalists</a> who <a href="http://michellemalkin.com/2010/12/07/rejecting-the-dream-act-and-the-radical-ethnic-tribalism-of-the-open-borders-lobby/">pretend to embrace assimilation</a> for show.</p>
<p>And remember: The CBO score estimated that the <a href="http://michellemalkin.com/2010/12/17/operation-buck-up-redux-stop-the-dream-act-sessions-last-action-alert/">last, failed DREAM Act</a> bill  <a href="http://michellemalkin.com/2010/12/07/rejecting-the-dream-act-and-the-radical-ethnic-tribalism-of-the-open-borders-lobby/">would increase projected deficits by more than $5 billion in at least one of the four consecutive 10-year periods starting in 2021.”</a></p>

<p>With great fanfare and elite media sympathy, Jose Antonio Vargas publicly declared himself an <a href="http://www.nytimes.com/2011/06/26/magazine/my-life-as-an-undocumented-immigrant.html">&#8220;undocumented immigrant&#8221;</a> this week. &#8220;Undocumented&#8221; my you-know-what. In the felony-friendly pages of The New York Crimes &#8212; er, Times &#8212; the <a href="http://defineamerican.com/">Pulitzer Prize-winning journalist turned illegal-alien activist</a> spilled the beans on all the illegal IDs he amassed over the years. He had documents coming out of his ears. </p>
<p>The Times featured full-color photos of Vargas&#8217; fake document trove &#8212; including a <a href="http://www.nytimes.com/imagepages/2011/06/26/magazine/26illegal2.html">a fake passport with a fake name, a fake green card and a Social Security card</a> his grandfather doctored for him at a Kinko&#8217;s. He committed perjury repeatedly on federal I-9 employment eligibility forms. In 2002, while pursuing his journalism career goals, an immigration lawyer told him he needed to accept the consequences of his law-breaking and return to his native Philippines.</p>
<p>Following the rules would have meant a 10-year bar to reentry into America. Making <a href="http://thelegalintelligencer.wordpress.com/2008/04/23/false-claims-of-citizenship-can-render-aliens-inadmissible/">false claims of citizenship</a> is a felony offense. <a href="http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00001028----000-.html">Document fraud</a> is a felony offense.</p>
<p>Vargas, who frames himself as a helpless victim, freely chose instead to secure yet more dummy documents. He used a friend&#8217;s address to obtain an Oregon driver&#8217;s license under false pretenses. It gave him an eight-year golden ticket to travel by car, board trains and airplanes, work at prestigious newspapers, and even gain access to the White House &#8212; where crack Secret Service agents allowed him to attend a state dinner using his bogus Social Security number. (Reminder: Illegal aliens were able to get through White House security <a href="http://www.jewishworldreview.com/michelle/malkin010303.asp">under the Bush administration, too.</a>)</p>
<p>At least Vargas tells the truth when he says he&#8217;s not alone. Go visit a <a href="http://michellemalkin.com/2006/05/17/9-11-and-7-11/">7-11 in the D.C. suburbs</a>. Or the countless <a href="http://articles.latimes.com/2005/nov/29/local/me-fakeid29">vendors in MacArthur Park</a>. Or any of the 19 cities in 11 states from Massachusetts to Ohio to Kentucky where a <a href="http://newsblog.projo.com/2011/02/us-ring-sold-fake-ids-to-immig.html">massive, Mexico-based &#8220;highly sophisticated and violent&#8221; fraudulent-document trafficking ring</a> operated until February 2011. <a href="http://michellemalkin.com/2006/03/30/documents-of-the-undocumented/">&#8220;Undocumented workers&#8221; and &#8220;undocumented immigrants&#8221; have plenty of documents.</a></p>

<p>The persistent use of these open-borders euphemisms to describe Vargas and countless millions like him is a perfect illumination of the <a href="http://michellemalkin.com/2006/04/14/the-open-borders-media/">agenda-driven</a>, <a href="http://michellemalkin.com/2006/08/28/the-medias-open-borders-bias/">dominant progressive media.</a></p>
<p>They&#8217;re as <a href="http://www.realclearpolitics.com/printpage/?url=http://www.realclearpolitics.com/articles/2007/05/a_lesson_in_openborders_math.html">activist</a> inside their newsrooms as Vargas is out in the open now. Bleeding-heart editors were hoaxed by a prominent colleague, exposed to liability, and yet still champion his serial subversion of the law. San Francisco Chronicle editor Phil Bronstein bragged that he was &#8220;<a href="http://www.sfgate.com/cgi-bin/blogs/bronstein/detail?entry_id=91589">duped</a>&#8221; by Vargas, but endorses his &#8220;subterfuge&#8221; because Vargas&#8217; lobbying campaign for the illegal-alien student bailout known as the DREAM Act &#8220;just might lubricate the politically tarred-up wheels of government and help craft sane immigration policy.&#8221;</p>
<p>Who&#8217;s insane? The Vargas deceit is not an object lesson about America&#8217;s failure to show compassion. It&#8217;s another stark reminder of America&#8217;s dangerous failure to learn from 9/11.</p>
<p>Time and again, security experts have warned about how jihadists have exploited lax immigration and ID enforcement. <a href="http://www.numbersusa.com/content/learn/illegal-immigration/drivers-licenses.html">Driver&#8217;s licenses are gateways</a> into the American mainstream. They allow residents to establish an identity and gain a foothold into their communities. They help you open bank accounts, enter secure facilities, board planes, and do things like <a href="http://michellemalkin.com/2006/12/10/illegal-aliens-seeking-hazmat-licenses/">drive tractor-trailers carrying hazardous materials.</a></p>
<p>It&#8217;s been nearly 10 years since several of the 19 <a href="http://www.humanevents.com/article.php?print=yes&#038;id=4220">9/11 hijackers operated in the country using hundreds of illicitly obtained fake driver&#8217;s licenses and IDs</a>. Most states tightened licensing rules, yet Vargas easily obtained a driver&#8217;s license not only in Oregon, but more recently in Washington State. He again used a friend&#8217;s residence to pass muster. Washington State&#8217;s licensing bureaucracy s<a href="http://community.seattletimes.nwsource.com/mobile/?type=story&#038;id=2015398907&#038;">till does not check citizenship</a>. The man sitting in the White House <a href="http://michellemalkin.com/2008/01/28/obama-crusades-for-illegal-alien-drivers-licenses-y-tu-mccain/">campaigned to keep driver&#8217;s license laws as loose as possible</a> for the open-borders lobby. He appointed <a href="http://michellemalkin.com/2010/07/07/open-borders-doj-vs-america/">illegal-alien lobbyists to top federal immigration positions</a>. His head of Immigration and Customs Enforcement just signed a memo <a href="http://michellemalkin.com/2011/06/22/document-drop-ice-memos-open-another-door-to-illegal-alien-amnesty-by-fiat/">pushing the DREAM Act through by administrative fiat</a>. And the <a href="http://michellemalkin.com/2009/04/03/obama-census-no-illegal-alien-left-behind/">privacy of illegal aliens</a> still trumps national security.</p>
<p>I ask again: Who&#8217;s insane?</p>
<p>Vargas believes his sob story is an argument for giving up on immigration enforcement and passing a mass amnesty. It&#8217;s a sob story, all right. Homeland security officials across the country should be weeping at the open mockery Vargas and his enablers have made of the law.</p>

I&#8217;ve also reported on <a href="http://michellemalkin.com/2010/11/22/dianne-feinstein-grants-an-illegal-alien-deportation-waiver/">how Congress issues individual deportation waivers</a> to illegal aliens. <p>On Friday, in another trademark Obama document dump, ICE issued a memo that pushes the <a href="http://michellemalkin.com/2010/12/17/operation-buck-up-redux-stop-the-dream-act-sessions-last-action-alert/">perpetually-rejected DREAM Act</a> for illegal alien students. As immigration lawyer Michelle Scopellite explained to me: &#8220;In essence, what this means is that if someone, is not a major criminal and is in removal proceedings, ICE officers are now to release them or terminate proceedings if they are involved in a lawsuit or fighting for union ideals. This appears to be another attempt by the Obama admin. to side-step immigration law through administrative acts.  My partner and I are just returning from the AILA conference where, we were more than likely, the only Republicans in attendance and the director of DHS and the ICE Director, both discussed this memo and it received rave reviews from the liberal wing of AILA.&#8221; There are actually two documents in the hopper, a more detailed six-page prosecutorial discretion memo and shorter policy summary:</p>

    * the person&#8217;s age, with particular consideration given to minors and the elderly;<br />
    * whether the person has a U.S. citizen or permanent resident spouse, child, or parent;<br />

			<content:encoded><![CDATA[<p>There is a bit of confusion on the Internet that needs to be cleared up about the Democrats&#8217; plans for the DREAM Act.</p>
<p>A number of readers have <a href="http://search.twitter.com/search?q=5281+dream">pointed</a> to a weekend post at FreeRepublic.com warning that <a href="http://www.freerepublic.com/focus/f-news/2644645/posts">the DREAM Act is &#8220;hidden&#8221; in another bill, H.R. 5281.</a></p>
<p>Senate staff explained to me today that DREAM was passed as an amendment to HR 5281 in the House and it was sent over as a “message,” which gave it privileged status so the Senate didn’t have to vote on a motion to proceed (simply a cloture vote). My Senate staff source added that it essentially gave the Democrats an avenue to bypass a procedural hurdle in the Senate, but since the Senate failed to proceed to the 3rd amendment (the DREAM Act), it is dead and HR 5281 does not include it.</p>
<p>All that said, as you know from my longtime coverage of the open-borders lobby, they never give up.</p>
<p>I&#8217;ve been using this Bush 43-era graphic of the night of the living shamnesty with good reason <a href="http://s.michellemalkin.com/wp/wp-content/uploads/2007/09/zombieamnesty2.jpg">for years</a>:</p>

<p>So while the Senate cloture vote on Saturday <a href="http://michellemalkin.com/2007/10/16/anti-sanctuary-measure-in-the-senate/">killed</a> the stand-alone DREAM Act yet again, no doubt it will be back in some form or another. As I pointed out over the weekend, Senate GOP leader Mitch McConnell&#8217;s troubling remark that the illegal alien student bailout &#8220;should be dealt with next year&#8221; opens the door for a Republican version of the bill that <a href="http://michellemalkin.com/2010/12/13/operation-buck-up-stop-the-dream-act-illegal-alien-student-bailout/">forced retiree Utah Sen. Bob Bennett</a> telegraphed last week.</p>
<p>Remember: There are soft-on-illegal-immigration radicals in both parties. Whatever election-year lip service they might pay to border enforcement, <a href="http://michellemalkin.com/2010/09/15/its-baaaack-reid-the-dream-act-and-a-reminder-about-open-borders-republicans-who-support-it/">none can be trusted </a> to do the right thing without your constant bucking up.</p>

<p>Remember: This is a brazen <a href="http://thehill.com/homenews/administration/129499-obama-hispanic-caucus-push-for-dream-act-passage-in-lame-duck">&#8220;down payment&#8221;</a> on a larger shamnesty.</p>

            Senator Reid has filed cloture of the House-passed version of the DREAM Act, setting up a vote this Saturday as the lame-duck session continues. Stunningly, it is fifth version introduced in the Senate in just over 2 months. Not one of the versions has received committee process. In fact, the House bill was introduced just one day prior to passage. Further, Senator Reid filled the tree, and won’t allow any amendments to the bill.</p>
<p>            Though the DREAM Act would grant mass amnesty, the lack of hearings and committee process means the public and the Senate have not had time to analyze the proposal. The Congressional Budget Office says that the DREAM Act is expected to add more than $5 billion to the federal deficit—a figure that will grow given that the CBO fails to take into account a multitude of factors, such as the resulting litigation, fraud, and chain migration.</p>
<p>            In addition to immediately placing an estimated 1–2 million illegal aliens on a path to citizenship (a number expected to grow since the bill has neither a cap nor a sunset), the DREAM Act will give them access to federal student loans and federal work-study programs. The bill allows illegal aliens to get legal status indefinitely by simply claiming they have a high school diploma or GED, and even opens eligibility to those with multiple criminal convictions.</p>
<p>            Once naturalized, aliens granted DREAM Act amnesty will then have the legal right to petition for entry of their family members, including their adult siblings and the parents who illegally brought or sent them to the United States—easily tripling the number of green cards.</p>
<p>Americans reject amnesty as long as the unacceptable lawlessness continues. But this bill simply incentivizes and rewards more illegality. And, if it passes, what principle would lawmakers cite to object to another amnesty, for another group, and another one after that? Its passage will only encourage more people to unlawfully enter our country expecting a DREAM Act of their own.</p>
<p>Ten Things You Need To Know About</p>
<p>The DREAM Act (H.R. 6497)</p>
<p><strong>1.            The DREAM Act Is NOT Limited to Children</strong></p>
<p>Proponents of the DREAM Act frequently claim the bill offers relief only to illegal alien “children.” Incredibly, previous versions of the DREAM Act had no age limit at all, so illegal aliens of any age who satisfied the Act’s requirements—not just children—could obtain lawful permanent resident (LPR) status. In response to this criticism, H.R. 6497 includes a requirement that aliens be under the age of 30 on the date of enactment to be eligible for LPR status. Even with this cap, many could be much older before petitioning for status—hardly the “children” the Act’s advocates keep talking about. The bill’s 30 year old age cap on “children” only applies to date of enactment, and the registration window will remain open indefinitely regardless of future age.</p>
<p><strong>2.            The DREAM Act Will Be Funded On the Backs Of Hard Working, Law-Abiding Americans</strong></p>
<p>Even though H.R. 6497 was introduced a day before it passed, the CBO released a score. Proponents of the DREAM Act have failed to acknowledge that CBO estimates the bill would increase projected deficits by more than $5 billion. But the number is likely to be dramatically higher. The CBO has clearly failed to account for a number of major costs factors with the DREAM Act, including increased unemployment of U.S. citizens, public education costs, chain migration, litigation and fraud. Nor does the CBO take it account what history has proven: passing amnesty will incentivize even more illegality and lawlessness at the border. In addition, the CBO assumes a large portion of those who receive amnesty will obtain jobs, but there is no surplus of job opportunities. The score doesn’t count those who can’t get jobs because of this competition and will claim unemployment benefits.</p>
<p>Though the House bill adds fees for initial applications and requests for extensions of aliens granted conditional status under the DREAM Act, none of the funds collected go to the agency for implementation of the program. As a result, Congress will still have to appropriate fees to cover the costs for adjudication of DREAM Act applications, or USCIS will have to force lawful applicants to foot the bill for illegal applicants seeking amnesty. Further, USCIS recently formalized a general fee waiver process whereby fees can be waived for a number of reasons. Finally, taxpayers would still be on the hook for all Federal benefits the DREAM Act seeks to offer illegal aliens, including student loans and grants.</p>
<p><strong>3.            The DREAM Act PROVIDES SAFE HARBOR FOR ANY ALIEN, Including Criminals, From Being Removed or Deported If They Simply Submit An Application   </strong></p>
<p>Although DREAM Act proponents claim it will benefit only those who meet certain age, presence, and educational requirements, amazingly H.R. 6497 still protects ANY alien who simply submits an application for status no matter how frivolous. The bill forbids the Secretary of Homeland Security from removing “any alien who has a pending application for conditional nonimmigrant status”—regardless of age or criminal record—providing a safe harbor for millions. Though the bill requires a modest “prima facie” showing of eligibility, this is the lowest standard of legal proof and could likely be satisfied by the alien’s signature. This loophole will open the floodgates for applications that could stay pending for many years or be litigated as a delay tactic to prevent the illegal aliens’ removal from the United States. Such delays will increase the number released on bail and will increase the number of absconders. The provision will further erode any chances of ending the rampant illegality and fraud in the existing system, and ensure that the bill becomes a surrender to illegality.</p>
<p><strong>4.            Certain Inadmissible Aliens, including those from high-risk regions, Will Be Eligible For Amnesty Under The DREAM Act</strong></p>
<p>Certain categories of criminal aliens will be eligible for the DREAM Act amnesty, including alien gang members. The DREAM Act allows the following illegal aliens to be eligible for amnesty: alien absconders (aliens who failed to attend their removal proceedings), aliens who have engaged in document fraud, aliens who have falsely claimed U.S. citizenship, and aliens who have been unlawfully present in the US, even after being previously removed.</p>
<p>The exemption for fraud is particularly troubling because it creates a potential loophole for unknown terrorists who have defrauded immigration authorizes—as was the case with the 9/11 hijackers. At the same time, limited federal resources that are better utilized on tracking down such fraud will have to be directed towards reviewing potentially fraudulent claims on millions of DREAM applications. Making matters worse, the DREAM Act still allows the Secretary to waive all grounds of inadmissibility for illegal aliens, including criminals and terrorists.</p>
<p><strong>5.            Certain Criminal Aliens—including drunk drivers—Will Be Eligible For Amnesty Under The DREAM Act</strong></p>
<p>Certain categories of criminal aliens can qualify for status under the DREAM Act. The bill includes a 1 felony/3-misdemeanor rule, similar to the 1986 amnesty rule. As a result, criminal aliens who have less than 3 misdemeanor convictions will remain eligible for legal, permanent status through the DREAM Act. Some misdemeanors can be extremely serious, such as driving under the influence, certain drug offenses, gang activity, some charges of sexual abuse of a minor, assault and battery, and even prostitution.</p>
<p> <strong></p>
<p>6.            Conservative Estimates Suggest That At Least 1.3 Million Illegal Aliens Will Be Eligible For the DREAM Act Amnesty. In Reality, We Have No Idea How Many Illegal Aliens Will Apply</strong></p>
<p>Section 6(i) of the House-passed DREAM Act waives all numerical limitations on green cards, and prohibits any numerical limitation on the number of aliens eligible for amnesty under its provisions. The Migration Policy Institute estimates that the DREAM Act will make approximately 1.3[1] million illegal aliens eligible for amnesty immediately. It is highly likely that the number of illegal aliens receiving amnesty under the DREAM Act will be much higher than estimated due to widespread fraud and our inherent inability to accurately estimate the illegal alien population. Estimates also fail to account for the chain migration which will inevitably occur once these illegal aliens are naturalized, and for children who will be eligible years down the road. Section 7 of the bill allows the Secretary to make those who have already met the Act’s requirements to become immediately eligible for LPR status.</p>
<p><strong>7.            The DREAM Act Does Not Require That An Illegal Alien Finish Any Type of Degree (Vocational, Two-Year, or Bachelor’s Degree) As A Condition of Amnesty</strong></p>
<p>DREAM Act supporters would have you believe that the bill is intended to benefit illegal immigrants who have graduated from high school and are on their way to earning college degrees. However, the bill is careful to ensure that illegal alien high school drop-outs will also be put on a pathway to citizenship – they simply have to get a GED and be admitted to “an institution of higher education.”</p>
<p>Under the Higher Education Act, an “institution of higher education” includes institutions that provide 2-year programs (community colleges) and any “school that provides not less than a 1-year program of training to prepare students for gainful employment” (a vocational school). To get LPR status, the alien must prove only that they finished 2 years of a bachelor’s degree program, not that they completed any program or earned any degree. If the alien is unable to complete 2 years of college but can demonstrate that their removal would result in hardship to themselves or their U.S. citizen or LPR spouse, child, or parent (the ones who brought them here illegally), the education requirement can be waived altogether. The bill actually allows illegal aliens to get legal status indefinitely without any college or military service.</p>
<p>Additionally, the bill provides no mechanism to combat the extensive fraud the will inevitably sue – there is no meaningful way to verify that applicants have met even the bill’s loosest residency and education provisions. The bill is subject to extensive abuse and will worsen an already chaotic immigration situation.</p>
<p><strong><br />
8.            The DREAM Act Does Not Require That an Illegal Alien Complete Military Service As A Condition For Amnesty, and There Is already A Legal Process In Place For Illegal Aliens to Obtain U.S. Citizenship Through Military Service</strong></p>
<p>DREAM Act supporters would have you believe that illegal aliens who don’t go to college will earn their citizenship through service in the U.S. Armed Forces. If the alien is unable to complete 2 years in the Armed Forces, and can demonstrate that their removal would result in hardship to themselves or their U.S. citizen or LPR spouse, child, or parent, the military service requirement can be waived altogether. Such claims will likely engender much litigation and place a huge burden on DHS.</p>
<p>Furthermore, under current law (10 USC § 504), the Secretary of Defense can authorize (and presently does) the enlistment of illegal aliens. Once enlisted in the U.S. Armed Forces, under 8 USC § 1440, these illegal aliens can become naturalized citizens through expedited processing, often obtaining U.S. citizenship in six months. All branches of the military are currently meeting their recruitment goals.</p>
<p><strong><br />
9.            Despite Their Current Illegal Status, DREAM Act Aliens Will Be Given All The Rights That Legal Immigrants Receive—Including The Legal Right To Sponsor Their Parents and Extended Family Members For Immigration</strong></p>
<p>Under current federal law, U.S. citizens have the right to immigrate their “immediate relatives” to the U.S. without regard to numerical caps. Similarly, lawful permanent residents can immigrate their spouses and children to the U.S. as long as they retain their status. This means illegal aliens who receive amnesty under the DREAM Act will have the right to petition for their family members—including the parents who sent for or brought them to the U.S. illegally in the first place—in unlimited numbers as soon as they become U.S. citizens and are 21 years of age.</p>
<p>Additionally, amnestied aliens who become U.S. citizens will be able to petition for their adult siblings living abroad to immigrate to the U.S., further incentivizing chain migration and potentially illegal entry into the United States (for those who don’t want to wait for the petition process overseas). When an adult brother or sister receives a green card, the family (spouse and children) of the adult sibling receive green cards as well.</p>
<p><strong>10.        Current Illegal Aliens Will Get Federal Student Loans, Federal Work Study Programs, and Other Forms of Federal Financial Aid</strong></p>
<p>Section 11 of H.R. 6497 allows illegal aliens amnestied under the bill’s provisions to qualify for federal student assistance under Title IV of the Higher Education Act of 1965 (20 U.S.C. 1001 et seq.) in the form of federal student loans, grants, work-study programs, and other education services such as tutoring and counseling.</p>
<p>Previous versions of the DREAM Act included a provision repealing the federal law that prohibits states from providing in-state tuition unless it’s similarly offered to citizens and legally present aliens living in other states. Despite the federal ban put in place over 14 years ago, at least 10 states directly violate this law. Enactment of the DREAM Act will only incentivize more states to provide financial assistance to illegal aliens over American students.</p>

<p>Four suspects are in custody.</p>

<blockquote><p>A Border Patrol agent was shot and killed Tuesday night near Rio Rico after encountering several suspects, federal authorities said Wednesday.</p>
<p>Agent Brian Terry was killed just 10 miles north of the U.S.-Mexico border, north of Nogales. Four suspects are in custody and one is being pursued, according to a press release from Customs and Border Protection.</p>
<p>The Federal Bureau of Investigation and the Santa Cruz County Sheriff&#8217;s Office are investigating.</p></blockquote>
<p>Meanwhile, Senate Democrats continue to push the pro-amnesty DREAM Act and security-undermining environmental land grabs.</p>

<p>The big buzz in Washington this afternoon is over Senate Majority Leader Harry Reid&#8217;s warning to colleagues that they&#8217;ll be working right up until Christmas &#8212; and perhaps beyond. Word is that he&#8217;ll try to keep the Senate in session until the very last seconds before the new Congress opens on January 5, 2011.</p>
<p>This means more time to pass all the last-ditch political pay-offs and massive expansions of government power, including DADT, the DREAM Act, and a little-noticed land grab omnibus bill which is the subject of my column tomorrow.</p>

<p>Dems gone wild. Reid and company drop a $1.1 trillion omnibus spending bill, via Matt Cover at <a href="http://www.cnsnews.com/news/article/democrats-introduce-near-2000-page-11-tr">CNSNews.com</a>:</p>
<blockquote><p>Senate Democrats today introduced a 1,924-page omnibus spending bill for fiscal year 2011, forgoing a planned continuing resolution to fund the federal government until the next Congress could take up the issue after Jan. 3.</p>
<p>The massive bill, the FY2011 Omnibus Appropriations Act, includes funding for the new health care law backed by the Obama administration, an increased number of I.R.S. agents, and an unknown number of earmarks.</p>
<p>The Senate had been scheduled to adjourn on Dec. 17, meaning that unless Majority Leader Harry Reid (D-Nev.) elects to extend the current session, which he has hinted at doing, the bill theoretically would be voted on in less than three days. Reid has said that Congress could return right after Christmas to finish up legislative business.</p>
<p>The current continuing resolution to keep the government running expires on Dec. 18, meaning that unless new funding is approved &#8212; either with another continuing resolution or the omnibus bill &#8212;  the federal government will be forced to shut down.</p>
<p>The omnibus spending  bill is reported to cost $1.1 trillion, according to The Hill. </p></blockquote>

Kent has been actively developing international labor exchange programs in the Pacific Rim with China, Japan, Vietnam, and Korea.</p>
<p>     Kent regularly addresses labor, community, civil rights, university and student conferences throughout the country.  He writes extensively on labor issues, and co-edited a book entitled Teaching for Change:  Popular Education and the Labor Movement.  He has published two other books:  Voices for Justice:  Asian Pacific American Organizers and the New American Labor Movement, which has been translated into Chinese and Japanese, and Voices from the Front Lines:  Organizing Immigrant Workers in Los Angeles, a bilingual English-Spanish publication that is now in its second printing.</p>

<p>The obituary for the DREAM Act illegal alien student bailout is premature.</p>
<p>You know this because I&#8217;ve been writing about the ceaseless push to pass this brazen shamnesty plan <a href="http://michellemalkin.com/category/immigration/dream-act/">for years.</a></p>
<p>The Washington Post pronounced it &#8220;<a href="http://www.washingtonpost.com/wp-dyn/content/article/2010/12/11/AR2010121101838.html">shelved</a>&#8221; over the weekend.</p>
<p>Not so fast.</p>
<p>Via the Hill, the open-borders lobby is claiming <a href="http://thehill.com/homenews/house/133291-on-house-passage-of-dream-act-timing-was-everything">momentum</a>:</p>
<blockquote><p>When House Democrats last week passed the DREAM Act before the Senate had staged its vote, the timing was no accident.</p>
<p>Instead, the chronology was part of a carefully designed strategy — orchestrated, with some tension, between the two chambers — to grant the proposal its greatest shot at success. The fast-evolving process required behind-the-scenes scheduling changes; an 11th hour hearing; constant lobbying from supporters; and a risky-but-successful show of procedural gymnastics in the Senate — all aimed at lending momentum to the hot-button bill in hopes of enacting it by month&#8217;s end.</p>
<p>In short, supporters say, the process has infused life into the policy.</p>
<p>&#8220;It actually gives us a chance to win,&#8221; said Frank Sharry, executive director of America&#8217;s Voice, an advocacy group lobbying for the bill.</p>
<p>Adey Fisseha, policy attorney for the National Immigration Law Center, echoed that message. &#8220;It makes it real, and it increases the pressure,&#8221; Fisseha said. &#8220;They thought they had the votes. They wanted to lock it in. And they did.&#8221;</p>
<p>Indeed, had the Senate voted first, the bill likely would have failed, and the House would have lost its appetite to stage a vote at all, according to both supporters and critics of the proposal.</p></blockquote>
<p>The DREAM Act zealots are targeting Senate Republicans with more protests and hunger strikes. Those Republicans need bucking up.</p>
<p>GOP Sen. Scott Brown has been steady in his opposition to all forms of illegal alien amnesty, but a supportive call (or two or three) would be helpful as he faces a pro-DREAM <a href="http://www.bostonherald.com/news/politics/view/20101212advocates_to_make_last_dream_act_pitch_to_brown/srvc=home&#038;position=recent">p.r. onslaught:<br />
</a></p>
<blockquote><p>A coalition of advocates, educators and religious leaders have scheduled a press conference Monday at Boston City Hall to pressure the Massachusetts Republican to vote for the federal proposal.</p></blockquote>
<p>Same with <a href="http://www.dallasnews.com/sharedcontent/dws/news/nation/stories/DN-kbh_12nat.ART.State.Edition1.436cd8a.html">Sen. Hutchison:</a></p>
<blockquote><p> WASHINGTON – A national Hispanic Republican organization denounced Sen. Kay Bailey Hutchison&#8217;s opposition to the DREAM Act on Friday and warned that the stance may hurt her re-election prospects in 2012 should she decide to run.</p>
<p>&#8220;We are conservative Republicans who hold traditional military and social values,&#8221; the group Somos Republicans wrote in a letter to the senator. &#8220;We are troubled by the fact that you failed to recognize that Hispanics in Texas are overwhelmingly in support of the DREAM Act.&#8221;</p></blockquote>

<p>While you&#8217;re at it, you might want to put in a special phone call to retiring open-borders Utah GOP Sen. Bob Bennett (good riddance) and ask him to name names of the Republicans who support massive, costly illegal alien amnesties that undermine immigration enforcement and put law-breaking workers and students ahead of law-abiding ones. <a href="http://thehill.com/blogs/blog-briefing-room/news/133143-sen-bennett-gop-might-pass-own-version-of-dream-act-next-year">Do tell:</a></p>
<blockquote><p>Outgoing Sen. Bob Bennett (R-Utah) said Friday he&#8217;s privately discussed the prospect that Republicans would pursue their own version of the DREAM Act next year.</p>
<p>Bennett said he would vote for the immigration legislation, which gives immigrants who were illegally brought to the U.S. as children a conditional pathway to citizenship, if Senate Majority Leader Harry Reid (D-Nev.) brought it to the floor under the right conditions.</p>
<p>If that fails, the outgoing senator said, Republicans have privately discussed the prospects of writing and passing a version of the DREAM Act that could make its way through Congress.</p>
<p>&#8220;Now, I know a lot of my colleagues are not happy to vote for it, and I don&#8217;t think the votes &#8230; are there to pass it in this Congress,&#8221; Bennett said in his final conference call with Utah reporters. &#8220;And as I&#8217;ve talked, particularly to my Republican friends, I&#8217;ve said we really need to do this. Their reaction has been to me, privately, &#8216;You&#8217;re right. We do really need to do it.&#8217;&#8221;</p></blockquote>
